250. ARBITRATION, DRAFTING AND CONVEYANCING WITH LAW OF EVIDENCE

Answer any FOUR questions from Part - A
and TWO questions from Part - B.
All questions carry equal marks.
PART - A (4 × 20 = 80)
1. Explain relevant fact. When facts not otherwise
relevant becomes relevant fact ?
2. Define admission. Distinguish between
admission and confession.
3. What is hearsay evidence ? When the hearsay
evidence is admissible under the Indian
Evidence Act.
4. Define dying declaration. Explain the essentials
and evidenciary value of dying declaration.
5. Who is competent to give evidence ? Explain
the law relating to competency and
compellability of witness.
6. ?The improper admission or rejection of
evidence shall not be a ground of itself for a
new trial or reversal of any decision in any
case?. - Discuss.
PART - B (2 × 10 = 20)
7. Define arbitration agreement. Explain the
methods of settlement of dispute by arbitration
without intervention of Court.
8. Kannusamy, S/o. Velmurugan residing at
No. 3, Dindigul Main Road, Tiruchirappalli
borrowed a sum of Rs. 30,000 from
Muthulingam, S/o. Velayutham, a money lender
residing at No. 41, Bazar Street,
Tiruchirappalli, and agrees to repay the amount
with 18 % interest per year. Draft a promissory
note.
9. Seetharaman, S/o. Kothandaraman aged about
80 is the owner of agricultural land, measuring
two acres in survey No. 46/7, in Kattur
Village, Tiruchirappalli. There is a house in
the land, measuring 800 square feet. The total
value is Rs. 4,00,000. Seetharaman decided
to donate the land alongwith the house to his
grandson Sankaramurali, S/o. Manicka
Sundaram, residing at No. 4 Kandasamy Koil
Street , Tiruchirappalli. Draft a gift deed.
