PART A — (5 ? 8 = 40 marks)
Answer any FIVE questions.
1. Describe the essentials of a valid contract, when does an agreement become void?
2. What are the essential requisites of a valid tender of performance? What is the effect of refusal by the promise to accept correct tender of goods and money?
3. What are the rights and obligations of a finder of goods?
4. What are the different kinds of Agents? Under Law.
5. What are the rights of a partner? Under Commercial Act.
6. What do you think about negotiable instrument?
7. Define a ‘bill of lading’. How is it different from a charter party?
8. What is meant by actual total loss and constructive total loss in marine insurance?
PART B — (4 ? 15 = 60 marks)
Answer any FOUR questions.
9. State briefly the duties of an agent? Under commercial Law.
10. Does the sale of goods act provide for any rules as to delivery of goods? If so what are they?
11. What is the procedure for the Registration of a firm, and for recording subsequent changes? What is the evidential value of the entries in the Register of the firms? What is the effect of non-registration?
12. What are the respective rights and duties of common carriers and private carriers? Can a common carrier reduce his Liability by a special contract?
13. What are the powers and duties of an arbitrator?
14. Write short notes on
(a) Goods
(b) Document of title to goods
(c) Earnest.
15. Impossibility of performance is, as a rule, not an excuse for non-contract.
