CONSTITUTIONAL AND ADMINISTRATIVE LAWS

Paper V ? ADMINISTRATIVE PROCESS - NATURE AND SCOPE
Time : Three hours Maximum : 100 marks
Answer any FIVE questions.
All questions carry equal marks.

1. Define Administrative Law and describe the factors which are responsible for the enormous expansion of this law in recent years in India.

2. Discuss the Dicey?s views of Rule of Law and its impact on the development of administrative Law in U.K., explain it?s place in Indian judicial system.

3. Analyse the doctrine of separation of powers and it?s significance on the functions of present day administration.

4. How far classification of Administrative functions is important? What are the characteristics of Judicial and quasijudicial functions?

5. What do you understand Fran Delegated legislation, and describe the conditions subject to which the legislature may delegate its legislative power to the executive.

6. Judicial Control over delegated legislation can be exercised at two levels? elaborate the statement and write a critical note on judicial control on delegated legislation.

7. What is administrative discretion? To what extent the judiciary can control administrative discretion?

8. Discuss the nature and position of Administrative tribunals. What are the advantages of
tribunals compared to court system?
9. Write a note on French Administrative Courts and Tribunals.
10. Write short notes on any TWO of the following:
(a) Sub - delegation (b) Laying on the table
(c) Lok Sabha Committee on subordinate legislation
(d) Exclusion of Judicial Review.
