The Chairperson/president and members of the NHRC are appointed by the President of India. A Chairperson who has been a Retired/superannuated Chief Justice of the Supreme Court of India. The current Chairperson of NHRC is K.G. Balkrishnan.

The present chairperson of The National Human Right commission is the Honorable Chief Justice Mr K. G. Balkrishnan.

The chairman of NHRC is appointed by the President of India on the recommendation of a committee comprising of

-The Speaker of the House of the people
-The Minister in charge of Ministry of Home Affairs(MHA)
-The Leader of the opposition in the house of the people.
-The leader if the opposition in the council of states
-The Deputy chairmain of the council of states.
