    Is it a partial victory?

    In continuation of People are waiting for the judgement


    The long-awaited judgement has come. The five-judge bench of Hon'ble Supreme Court has suspended the 'triple talaq' system for six months in India. The five-judge bench has given a 3:2 verdict. Furthermore the bench under CJI JS Khehar has also directed the Government to frame a divorce law for the community within six months. Hon'ble Supreme Court, in the judgement, has declared the practice as "retrogade" and said that it "violates right to equality".

    After this partial victory, many ladies of the community distributed sweets (as seen in television). The true liberals also expressed their satisfaction. However, the liberals whom we see in various television channels have so far maintained silence.

    This is the great news for the Muslim women who were facing the Talaq issue and now it is kept in abeyance for six months and that surely a partial relief but a good step forward to their freedom.

    Supreme court has banned Triple Talak considering its misuse in the society as a large. Let us understand Triple Talak. The literal meaning of Annulment of marriage by repetition of three times Talak Seems to have misinterpreted the real meaning of it. Islam gives utmost importance to Institution of marriage. Islam is one of the religion which prohibits exploitation of women. Then why will it enforce a system as Triple Talak which is considered arbitrary. This is because Islam never considered divorce as normal course. To go a bit further Islam considers Triple Talak to be highest level misfortune in its religion. Islamic law (Both Shia and Sunni) clearly say uttering Talak brings highest level of misfortune even once. Islam gave detailed procedure for divorce which is much more difficult but purely based on consent of the Individuals which takes long time. It for example says Talak must not be said at a go. But only once in one Session. There are several other procedures which must be followed like presence of religious Ulema which details are too specific and technical. But present day self proclaimed Ulemas misuse its provisions and exploit it for personal benefit. Their improper reading of Hadith Law(A Sunni Islamic law) has rendered the process as a mockery.
    Supreme court presently has just put the above mockery process on hold and has tried to enter into the domain of Personal Laws. There are much higher debated and serious questions which must be asked before coming to any conclusion. Let us wait for the final result.

    This is a very commendable development for the country. People who play fowl will not do that anymore. I think Government will act quickly and bring in a divorce law to this community also which is there for other communities.
    We have to wait and watch the reactions of the people who are getting affected by this judgement. A real good development.

    For the first time we are witness to some great things happening in this country during NDA regime. First it was demonetization of weeding out old notes for new. Then corrupt people bought to the knees and now the triple talaak issue has been put to end giving greater relief to Muslim women. The Prime Minister Narender Modi has rightly observed that triple talaak is the womens emancipation and their right to equality has further widened. Now atrocities on Muslim women would subsidize and the husband would mend his ways to the liking of his wife so that cordial relations persists.

    Mr. Mohan: This is not the first time. Please don't forget jan-dhan yojna, de-monetisation, surgical strikes inside Myanmar and PoK, one after another rescue missions, GST, Make in India and various other schemes, the outcome of which would be clear in due course.
    Meanwhile, the ladies of the community are distributing sweets and religious leaders are getting more and more angry.

    It is really happy news for the muslim women that the government has suspended such petition for a span of six months. As per your statement @#606557 Gokul Sir,.. "Islam is one of the religion which prohibits exploitation of women". If they really think about their women community, then why do they not allow women in mosques, at their holy place, where they worship God. Here is a small extract from an article that I was reading "You go to Saudi Arabia… women are allowed in the Mosque, you go to London… women are allowed in the Mosque, you go to America… women are allowed in the Mosque – It is only in India, that they are prevented, and a few countries close by." This is what it said about women not allowed to go in Mosque and the reason they gave that they are not allowed is because if there will be men and women together it will distract their minds and they will not be able to concentrate to worship God. Do you think even at holy place such sort of a thinking should come and how could this exploit any women?
    A positive attitude will lead to positive results.

    Latest update: Ladies of the community are offering 'jalebis' to everybody in Delhi and Lucknow. The religious leaders and television-liberals are however refusing to take even a morsel of 'jalebi'.

    With this new order of the Supreme Court there must be rejig in various families which got disturbed by so called triple talaak so far. Surely the Khaziz would have field time to reunite those who had difference of opinion relations . And we could see Muslim women participating in various activities of National development soon. They may even contest in local, MLA and MP elections also.

    The historic judgement by the Hon'ble Supreme Court is indeed a victory for all the women belonging to the Muslim community. They have now been ensured protection of law against the uncivilized practice of Muthalaq. The order comes on a writ filed by a group of Muslim women against this barbaric practice. Though the order has only suspended the practice for six months, let us hope the government will take cue and act on the further proceedings.

    I agree with Gokul at #606557 that the practice that was being followed in India was not Islamic but was misinterpreted and misused by some self-proclaimed protectors of Islam. A religious belief as a whole cannot be crucified for the mistake committed by a few.

    Pooja at #606601, the very fact that there is no restriction on women offering prayers in Mosques in many parts of the world is proof that the restriction is not as per religious scriptures but as a result of its convenient interpretation by some religious leaders in some parts. In this connection, I would like to tell you that I have seen that a separate praying area is allotted within the Mosque for women in many parts of India including Kerala. We also need to understand the difference in the mode of offering prayers in different religions.
