    Know the new rape act

    Entire country has been appreciating the Modi government for promulgating the urgent ordnance and the details of which are appended below.

    If 12 year old or lesser age child gang raped the rapists would be given hang till death. If a child below 12 years of age by single person, Life Imprisonment. If 16 years or less gang rapists would be declined advanced bail. And for a single rapist of 16 years girl, 20 years rigorous punishment. And for those indulging in child raping , the rapists would be sentenced to 7 to 10 years imprisonment.

    It is good an initiative has been taken by the government to decide on the punishment on the culprits in various rape cases. Now another point in the GO is no anticipatory bail for the suspects in this case. This is also a good clause in the order. Specifying the time limit is another good point in this GO.
    As discussed earlier in a similar thread the investigation part is to be taken care. Once the investigation has been carried out in a flawless way, this will help the victim at least to have the satisfaction is that the real culprit is punished. Anyhow, it is a good step forward and let us wait and see the reaction from the others.

    While I appreciate the Rape act and the punishment awarded, I strongly recommend a special court to deal with rape cases. The rape cases should be heard and dealt with sparing no time to give the verdict. The court should function 24x7 without any holiday.

    Yes fast track courts must be in place to take up such cases on war footing and award punishment.

    Mr Mohan, if I am not mistaken, this is the second thread you are raising on the same topic. In this thread, you have just shared the information that has been passed on by the media as a matter of fact. Do you want to discuss anything specific with regard to the new law? Please bring out some ifs and buts, as you see it, for discussion instead of simply sharing an information. And, fast-track courts are already part of the Ordnance.

    Most of the sentences have been increased and death sentence can be handed over. With regards to fast track, all cases need to be completed in 2 months with a maximum time for appeals set at 6 months. SO, by 8-10 months the victim and family should get justice.

    This needs preparation for resources and infrastructure on a war footing, which the Government needs funds and the commitment. The trial courts, the judges, the prosecutors, the police staff, the forensic experts etc. We also need a national online portal that law agencies can feed in the pattern and profiles, including fingerprinting. This should be linked to government identity documents so that, the accused or repeat offenders can be spotted quickly and dealt with.
