"The Lieutenant Governor of Delhi bound by the advice of the Elected Government."

The Supreme Court of India today gave its judgment on the Delhi Governments appeal challenging the High Court judgment holding the Lieutenant Governor(L.G.) as the administrative head of the Capital. The Supreme Court made it clear that the l.G. of Delhi is bound by the advice of the elected government in all matters except land, police and public order. This judgment has put an end to the ongoing tussle between the L.G. and the AAP Government. The L.G. now has to respect the decisions taken by the elected government and act on the advice of the council of ministers. This is a victory for the AAP Government and I hope the government will live up to the expectations of the public of Delhi who voted them to power with an overwhelming majority.

Good that the court has to interfere in the on going tussle between the governor of the Delhi and the AAP government. But this judgement should have come long back as the face off between the government and governor of Delhi has reached maximum on every issue and throws bad name against the center which has been blamed for hijacking the state rights and authorities through the office of governor by interfering and restricting every order taken out by the elected government and that practice has been put on hold by the court. Delhi CM Kejriwal must be happy man.

Now as the matter has been resolved with the court's intervention, I am hoping to witness the drastic changes in the administration as well along with the areas of policy making & its implementation. The AAP, the so called the self declared honest party will show some delicateness & commitment to improve the situation in Delhi which since long got missing.

In addition, I am intend to listen to the appreciations towards our Judiciary system from the so called the secular parties including the Congress & the Left parties who so far have believed to have the bias judgments under the influence of the Central government. But sadly they would have some more diverted debates.

I try to see the issue from a different angle. Hon'ble Supreme Court has given a direction in respect of the functioning of Lt.-Governor of Delhi about which the Constitution is silent. But this direction will create different sort of problem for AAP Ministers. They can no longer blame Lt.-Governor for their inefficiency and inactivity. By the way, the CM of Delhi has proceeded to Bengaluru for the treatment after enjoying the sleep-cum-dharna in the Guest Room of the residence of the Lt.-Governor.

Although AAP has been projecting the ruling as the victory for the party, it is nothing but a clarificatory ruling by the Supreme Court on an issue about which the Constitution is silent.

I agree with Partha Sir that the Kejriwal led AAP government will no longer enjoy the dysfunction & at the same time go on blaming the Governor & the Central government for their interference. Now as the matter has been clarified the AAP government has left with the little choice in the coming elections.

All these days AAP is trying to show the Governor as the reason for their inaction on all the fields and blaming the BJP Government for all this. But now the ruling of Supreme Court will remove their hindrance. So it is a do or die situation for them, Let them see that all their election promises will be fulfilled and they will have the chance of coming to power again, All the best to AAP.

That the BJP is always trying to fish in troubled markets is a statement of truth. One really wonders if the 8 lane road project between Salem and Chennai was announced only to divert attention from the alleged misbehavior of the Governor, who has had the habit of getting into one controversy or the other. The TN Governor has clearly exceeded his powers. The brilliant police official that she once was, Kiren Bedi of Pondicherry was another thorn in the flesh of the Chief Minister. This lady has acted as if she was an extra constitutional authority.

The BJP will now be stopped in its tracks at least for a short while.

The ongoing tussle between the Delhi legislature and executive is far from over. Hours after the Supreme Court verdict clarifying the power of L-G of Delhi, the AAP government moved its first file, ordering the withdrawal of authority on transfer and posting of bureaucrats from the L-G, Chief Secretary and various Heads of the Departments. But the concerned Officers sent back the "legally incorrect" order to Deputy CM Manish Sisodia.

The AAP nonsense won't continue. The bureaucrats are toughening their stand.

The Supreme Court made it very clear that the Lieutenant Governor does not have any independent decision-making powers and is bound to act on the aid and advice of the Council of Ministers. The action of the officers sending back the orders of the Deputy Chief Minister of Delhi will be at their own risk and is likely to attract contempt of court. It is better for the officers to come to their senses as early as possible in their own interest. This action clearly indicates their defiance to the Supreme Court orders. Their game is up and they have to fall in line.
