New judgement on Life term imprisonment

Duration of life term imprisonment is enhanced to 30 years in a judgement given by the Supreme Court.The Bench of Justice consists of Justice B S Chauhan and Justice F M I Kalifulla.The imprisonment was given to a father who raped and killed his 4 year old daughter and a boy who killed her pregnant girlfriend when she refuses to abort.
Life term Imprisonment
Life term imprisonment or lifelong imprisonment is a punishment given for a serious crime. In this penalty, a person accused of severe crime should live the rest of his life in prison. In India, there are nine offences in the
Indian Penal Code
and 14 other offences in local or special laws providing life term imprisonment.
Crimes fall under this Act
The crimes which fall under life term imprisonment are as follows:
(i)
Severe child abuse
(ii) Murder
(iii) Rape
(iv) Drug dealing severe cases
(v) Serious cases of burglary or robbery which results in death o individuals
(vi) Human trafficking
(vii) High treason
(viii) Severe bodily harm
The term of punishment varies in case to case.
Some countries abolish the law of life term imprisonment. The first country to abolish this punishment is
Portugal
followed by South and Central America, Honduras, El Salvador, Venezuela, Bolivia, Costa Rica, Ecuador, Uruguay, Dominican Republic etc. The only Asian country which abolished the life term imprisonment is Chinese Dependency (special Administrative region).
India still continuing Life term imprisonment
India is still continuing this penalty in cases which are regarded as
"rarest of rare"
.
Life term imprisonment generally means punishment to live the remaining life in prison but practically it is given for 14 years. In many cases, accused are given life term imprisonment for 20 or 25 years. In a recent judgment given by bench of Supreme Court, the Court said that the duration of life term should not be less than
30 years
as per society's demand for punishment to severe crimes. The bench consisted of justice B S Chauhan and Justice F M I Kalifulla. They ordered this imprisonment for two accused. First one is a father who raped and killed his four year old daughter and the other is a boy who killed his girlfriend when she refused to abort. According to Justice Chauhan, the first case is not the rarest of rare but the nature of offence, age and relationship made them to punish life term imprisonment without remission.
And the second case is deliberately planned which showed inhuman nature which touches conscience of every individual. It disturbs the moral fiber of the society. The accused is also given lifelong imprisonment of thirty years without remission.
