How to submit a RTI complaint?
RTI Right to information. RTI means if any particular citizen Is facing issues with any particular government officials or with any government bodies, then the citizen is having right to file complaint against them and the supreme court will take appropriate action and other legal measures. In this section let’s see about the article right to information, how it works, how to file the complaint, and number of days interval to appeal against the government bodies are described in this section.
India is a democratic nation. So each and every citizen is having rights to check on the particular government bodies. If the government bodies are not acting legally then the citizen is having right to file a case or complaint against them. This is called as right to information. And all the citizen in India say unemployed person also having rights to question any government or government officials, if they are not acting legally. And this is the fundamental rights and duties of every citizen, so the Supreme Court had passed a law like if any government authorities or the officials are not working legally then RTI complaint can be filed against them and the court will take charge of them upon enquiry.
Evolution of RTI
RTI – Right to information act is passed by almost all the states to overview the state issues. But this law is passed by central government board of authorities on 12th Oct 2005. Even the citizen is having right to file RTI against private bodies which are affiliated to government. This RTI reinforces a different activity that has to be carried out by the citizen of India against the government.
How RTI works?
Suppose let's take a live example to discuss this issue, say the Airtel/BSNL internet bill is getting generated for every month even after the disconnection of the facility. The person disconnected the facility on May-2011. After settling all the bills also, the bill is getting generated for July, August, Sep, Oct -2011 etc. At this case, the person is having rights to approach RTI. Public information officer (PIO) is the government officials will be there for all the government and government recognized private organization. And these officers are called as nodal officers. So for filing the complaint we can approach the nodal officers. Nodal officers will be there for each department and in case if the nodal officer is not responding to the request then we can forward the same complaint to the head nodal officer. And these officers will collect all the complaints and they will forward it to the right division of RTI team. RTI team will then analyze and enquire about the complaint and will take the necessary step for the clearance of the issue.
RTI process and its working progress –
Once the complaint is filed then the associated division manager will take necessary steps in 30 days. So the application will get the status about the complaint in 30 days. In the absence of public information officer, one can file the complaint with assistant public information officer (APIO) and in that case the maximum wait days to get the response are 35 days. But in case if the complaint is very serious which is affecting the life of the person then the complaint is called as high critical complaint and the response has to be received in 24-48 hours. And if I am not received any information after 30 days and within 60 days or if the information provided by them is not very much satisfactory then the applicant can approach the senior PIO. And this senior PIO is called as first appellate officer. For applying the first appeal, its not necessary to file the application or to pay the fees. He can just draft his complaint in a sheet of paper. After this first appeal process, the applicant has to wait for 30 more days and if he is not getting any feedback or satisfactory feedback then he can approach for the second appeal which is considered as a highest appeal. The second appeal should contain all the details and the associated form of all the appeal and has to be submitted to the senior much PIO (public information officer).
Information to be included in RTI complaint-
Let's take an example of getting telephone connection. If the network is available for that particular area then the applicant should get the connection within 10-15 days and not more than that. But if it is taking more than 45 days then the applicant is filing a complaint saying-
I am XXX living in Bihar, filed a new telephone connection 15th may 2011 but it past 45 days and I am not still not given an information on the same.
So please let me know the daily progress of my application and the officer who is handling my application. The officer name and his contact details. What RTI has done to the officer for failing from his act. How long it will take for me to get the connection.
By filing the RTI complaint like this, the applicant should get reply or the connection within 10-15 days maximum.
Escalations level of RTI-
How to make the issues reachable to the right RTI division is that we can approach PIO (Public information officer) via email, letter or by writing a complaint and giving to him directly and the other way to reach the right RTI division is by means of post office. If we are facing any issues which is not resolvable after several complaints then, we can go to the post office and file an RTI compliant. For filing the complaint, we have to fill the application form and also we have to submit the related documents like bills vouches, complaint mail to the government etc. For inspecting these documents there are some fees associated with it. It is on per hour basis. For the first hour for inspecting those documents, there is not fee structure. For the second hour of inspection of the document we have to pay Rs.5 and for the subsequent hours, one has to pay Rs.5. We can pay these amounts as cash in post office counter or we can pay it as a DD or by money order or cheque etc. For filling the application form we have to provide Rs.10 at the counter in post office. Upon filing the complaint, they will issue the complaint number and the acknowledgement details. And then the post office will take the complaint to the correct RTI division to overlook this issue.
Some important points on RTI
Suppose if the information given by the government officials or by the government recognized board is wrong or if it fails to provide information to public then fine of Rs. 250 – 25000 can be imposed on a particular person based on the complaint type. And these amounts will be deducted from the government officials salary.

Even the government officials who are getting bribe from the public can also be penalized under RTI. Upon filing the RTI complaint, RTI division will pass the information or the complaint to the CBI agency. And they will take the appropriate action.
