INSTRUCTIONS TO TENDERERS
1. Please do not tear off any leaf of this tender form document.
2. Please read these terms and conditions carefully before filing the tender. Mistakes in filling in the tender form may lead to disqualification of the tender partly or wholly.
3. Please sign all the pages of this tender document.
4. Cost of preparation of the tender shall have to be born by the tendering party.
5. Only the parties who satisfy the conditions of the tender and to whom this tender document is issued or their specifically authorized dealers only can apply.
6. Qualifications for Tendering :- The sealed tenders must be submitted in two bid system, i.e., Technical bid and Financial bid, both sealed in separate envelopes.
(A)Technical Bid should contains Technical Documents, Performance Capacity, Capability, EMD etc. (No rates of equipments should be mentioned)
(B) Financial Bid should contains only Rate
7. Procedure for Filling the Tender Forms :
i) The tendering party may quote for some or all the parts of items mentioned in the tender. Only the relevant parts of the tender quoted by the party may be filled. Other parts may be left blank with the words ‘Not quoted’ written at the top margin of the page and duly authenticated the same with full signature.
ii) The details specifications for instruments have been listed in ‘Bill of Quantity’ enclosed as Annexure-II.
iii) The specifications given in the Bill of quantity are to be strictly adhered to. Wherever, the specifications of any particular item/related item are not available, same may be given by the firm along with the rates.
iv) Any tender or offer which falls short of these specifications will be rejected summarily.
v) Striking out/applying whitener or disfiguring any specifications as printed in tender form is not allowed. Any such act shall lead to the disqualification of the tender, if in the opinion of the committee for making these purchases, such an act is deemed as deliberate. It may lead to disqualification of the tender partly or fully and forfeiture of whole or part of EMD as decided by the Tender Evaluation Committee set up by the Babasaheb Bhimrao Ambedkar University for affecting these purchases.
vi) Tender forms should be filled legibly in English with ink, strike off any mistakes in filling the form, re-write correctly and authenticate such corrections with signature. Applying whitener or overwriting is not
allowed. Failure to comply with these instructions may render the tender document invalid fully or partly.
vii) In case of a few specifications, brand name is required to be indicated.
viii) If the item being quoted has any other important features, besides the essential specifications mentioned in Annexure-II. It can be mentioned separately.
ix) Wherever required, sketches of instruments quoted may be provided to avoid ambiguity at later stage.
x) Wherever required, rates should be supported with samples.
8. Earnest Money Deposit (EMD)
i) Tenders to be accompanied by demand draft of Rs 2,000/= (Rs Two thousand only) payable at Lucknow from any scheduled bank towards the Earnest Money Deposit in favor of the Finance Officer, Babasaheb Bhimrao Ambedkar University, Lucknow (as per Annexure –I). Amount shown against the items in the tender schedule can be given in one D.D. for all equipments.
ii) EMD shall be kept with the BBA University and shall not bear any interest. It shall be refunded/EMD may be discharged only after the tenderer has discharged all his/ its obligations under the contract.
iii) The EMD in any other form will not be accepted.
iv) Tender submitted without EMD will not be accepted.
v) The EMD in respect of unsuccessfully tenders shall be returned within two weeks from the date of finalization of tender, provided their representative with appropriate authority presented himself in our office within that period failing which the same will be returned by post entirely at the cost and risk of tenderer.
vi) The EMD of the successful tenderer will be retained by the BBAU until the tenderer has complied with all its/his obligation under the contract.
9. Firm have to submit copies of Order executed to government / Semi-government educational institutes and payment received in last three financial years along with Technical Bids.

16. Submission On Tenders:
i) Annexure-I & II annexed to the document is to be filled.
ii) The tender should be submitted in two super scribing “Technical” and “Financial” bids which are to be enveloped in two separate covers. Both these sealed covers containing the technical and financial bids may be put into one sufficiently large envelope.
iii) Complete tenders containing duly filled in tender booklet, technical brochures, DD for the EMD and the receipt foil issued by this University as proof of having purchased the tender document booklet (Those Firm who has downloaded the form from university website should also enclose DD of Rs. 2000/= in favor of Finance Officer, BBA University, Lucknow) and a covering letter on the tenderer’s letter head with their complete address should be kept into a sufficiently large envelope. The envelope should be sealed and super scribed with “Tender for Scientific Equipments for University Science Instrumentation Centre, BBAU, Lucknow”.
iv) The envelope containing the tender should be addressed to the Registrar, Babasaheb Bhimrao Ambedkar University, Lucknow-226025.
v) The tender should reach the office at the above address within the time and date prescribed, BBAUniversity shall not be responsible for any postal or courier delays.
17. TENDERS RECEIVED AFTER THE DUE TIME AND DATE SHALL NOT BE ENTERTAINED.
18. Tenders not submitted in the prescribed tender form or unauthorized copies of our tender document will be invalid and shall be summarily rejected.
19. Sale of Tender Document Booklet:
After publication of Tender Notice to 21st March 2008, on all working days between 10.00 am to 5.00 pm from Monday to Friday (Lunch time 1:30 pm to 2.00 pm)), Tender document may be purchased from the Accounts Section, Babasaheb Bhimrao Ambedkar University, Lucknow. The cost of the Tender Form is Rs.2000/=. and it is not refundable.
20. Last date for receipt of completed tenders is 21st .March 2008, up to 1:00 pm herein after referred to as the “Tender Acceptance Date”.
21. Validity Offers:
i) Offer made in the tender shall be valid for acceptance by BBAUniversity till six months from the date of opening of tenders.
ii) Any unsolicited correspondence after the last date and time for receipt of tenders is liable to render the tender/offer as invalid. Tendering parties are, therefore, advised in their own interest, to desist from any uninvited correspondence after the said date.
iii) No alteration or amendments shall be allowed after opening of the tenders.
iv) For the tender to be valid, the individuals signing the tender document must specify:
(a) Whether they are signing as sole proprietor/ manufacturers.
v) Offers not accompanied by letters of authority, wherever required are liable to be rejected.
22. Opening Of Tenders:
i) Tenders shall be opened in the office of the Registrar, Babasaheb Bhimrao Ambedkar University, Lucknow at 2:00 pm on 21st March 2008.
ii) Tenders shall be opened in the presence of the tendering parties, who are willing to present at that time.
iii) The commercial Terms of the tenders shall be read out only one by one. Polite queries about rates etc. can be re-read on request. Parties are however, requested to desist from making comments.
23. Demonstration and Techno-Commercial Negotiations:
i) The acceptance of an offer in whole or in part shall be communicated to the successful tenders in due course and in writing. It is expected that tenderer has strong presence at Lucknow.
ii) The tenderer may be asked to present a demonstration/presentation of their items at a week’s notice on a fixed date. The cost of such demonstration, presentation, tests shall have to be borne by the tendering party.
iii) The tenderer should either in person or through his authorized representative be present at the time of demonstration and testing for techno-commercial negotiation.
iv) Calling of tender/s for demonstration or for techno-commercial negotiations does not confer any rights on any tenderer. It only means that the office made is under consideration.

1. General Conditions:
1.1 The Vice Chancellor, Babasaheb Bhimrao Ambedkar University, Lucknow (herein after referred to the Vice Chancellor, reserves the right without assigning any reason, therefore, to:
(a) Accept or reject the tender either in whole or in part
(b) Reject any or all the tenders, partly or wholly
(c) Cancel or withdraw the tender notice.
1.2 The BBAUniversity may in sole discretions to purchase all goods or majority of the goods from one tenderer.
1.3 The Vice Chancellor is not bound to accept the lowest tender or lowest part of any tender.
2. Supply by the Successful Tenderer/s:
2.1 On receipt of orders for supply of the whole or part of the order the tenderer shall have to affect supply of the entire order with the time and satisfying other conditions stipulated herein.
2.2 The equipments and other items related that are required for the University Science Instrumentation Centre, Babasaheb Bhimrao Ambedkar University, Lucknow.
2.3 Items against order placed by the University with successful tenderer within the validity period shall be supplied at the quoted or agreed rate.
2.4 The University reserves the right to place the order on any tenderer in whole or in part, so also split the order between one or more than one tenderer.
2.5 Terms of payment will be as follows:
i) 90% of the value of purchase order will be paid on delivery of the equipments and their installation. The tenderer has to obtain delivery and installation certificate duly signed by the Director, University Science Instrumentation Centre of the University and should submit the same for claiming the payment.
ii) 10% of the value of purchase order will be kept as security. Deposit and would be paid after one year of the satisfactory performance of the articles supplied and installed or from the one year from the date of release of 90% payment whichever occurs later. Tenderer shall have to rectify any defects in the equipments supplied/fixed in position during this period, failing which the same shall be made good by the University and the balance 10% shall be forfeited by the University.
iii) EMD may be adjusted against the 10% kept as Security deposit if the tenderer so desires.
iv) Tenderer would be required to provide the warrantee/ guarantee of the branded items if any as per the manual and direction of the manufacturer for which Indemnity Bond is required to be submitted to the University for the value of the branded items at the time of release of balance 10% Security deposit for a period till warrantee/guarantee on such branded items list.
v) The BBAU is an Educational Institution, Special discount, if any, available to the educational institutions from the tenderer/ their principals/s shall be passed on to the BBAU.
2.6 Before the dispatch of the equipments tenderer shall make arrangements free of cost at factory or go down for the representative of the BBAUniversity or any person or agency designated by the BBAUniversity to observe and check before packing and dispatching of the same if University so desires.
2.7 On arrival of the equipments at the sites, the tenderer shall arrange for the following services without extra cost to the BBAUniversity namely.
a. To carryout on site unpacking and positioning of the items.
b. To inspect the material and assess damage in transit, if any, and advise the same to BBAUniversity.
c. To rectify the damage, if any at the tenderer’s cost.
d. To replace the material with the fresh one in case of extensive damage to the equipments.
e. To fix them at position.
The material should be delivered at their respective places of delivery within a maximum period of 6 weeks from the date of firm order or as indicated in the purchase order. However, early deliveries will be preferred. This is the essence of contract.
4. Liquidated Damages:
Delay in deliveries will make the tenderer liable to pay to Babasaheb Bhimrao Ambedkar University liquidated damages calculated @ 0.5% of the total value of the order for every week of delay or a part of the week thereof subject to a maximum of 2.5% of the total value of the order which the Babasaheb Bhimrao Ambedkar University shall be entitled to deduct from any sums due and payable to the tenderer or otherwise recovered from him. In the event of persistent delay, the order will be liable to be cancelled, besides the tenderer being liable to pay the liquidated damages.
5. Liquidation/Winding Up:
For the purpose of this contract the tenderer shall be deemed to have been liquidated /winding up if official receiver / liquidator/official assignee is a appointed by the court.
In the event of any official Receiver or Liquidator or Official assignee being appointed for the tenderer, Babasaheb Bhimrao Ambedkar University shall be entitled to treat such event as a breach of agreement on the tenderer’s part and it shall be entitled to revoke this agreement without prejudice to the rights that have already accrued to under this agreement.
6. Dispute:
Any dispute with regard to this tender or its conclusion shall be referred to the tenderer (evaluation) committee constituted by Babasaheb Bhimrao Ambedkar University for making these purchases. The Vice Chancellor’s decision in this matter shall be final.
7. Jurisdiction:
This contract shall be deemed to have been concluded in Lucknow and courts at Lucknow have jurisdiction to the exclusion of all other courts.
8. Acceptance:
Signing of the tender form and the detailed terms and conditions by/on behalf of the tenderer shall be deemed as the final acceptance of these terms and conditions.
9. For any purposes General Financial Rules-2005 will be applicable .(DGS & D Guidelines)
