The Karnataka High Court on Friday recalled a non-bailable warrant (NBW) it had issued against a Block Education Officer (BEO) for failing to furnish records pertaining to the constitution of a School Development Monitoring Committee (SDMC) in Bellary district.
Justice Ajit Gunjal was dealing with two writ petitions relating to the constitution of SDMCs.
A member of the earlier SDMC of Government Higher Primary School of Obalapura village had challenged the dissolution of the committee ahead of its term. Subsequently, a member of the new committee too had filed a writ petition.
The court had repeatedly asked the BEO of Hagaribommanahalli under whose jurisdiction the school came, to place records pertaining to the SDMCs. When the BEO failed to respond, the court had taken note of the conduct of the official and ordered issue of NBW.
When the matter came up on Friday, the BEO filed an affidavit in the court. He submitted that two court orders on the issue had reached him on August 17 and on August 20 and that he was on leave till August 18.
The judge accepted the apology, recalled the warrant and disposed of the petition giving liberty to the Government to constitute a fresh SDMC after the tenure of the old committee expired.
