  • Is an affidavit sufficient to authenticate different names in documents?


    Worried that the actual names of your parents differ from those in your academic and other documents and want to know if a legal affidavit is sufficient to authenticate it? Check out the suggestions that could help you to take more steps in the matter.

    There was a mistake in my parents' names on the 10th and 12th mark sheets and I realized it too late. I could not get them corrected as the time limit for correction expired. So in all my documents from birth certificate to my passport, my parents name is mentioned differently from what their names are mentioned in their own documents.

    I consulted an advocate and he advised me to keep using the names as per the mark sheet. My parents have also made an affidavit stating that the names in their documents and my documents refer to one and the same person.

    Is this affidavit enough if the need arises or is there something else I can do? Kindly advise.

  • These days many are asking for a gazette notification also in addition to an affidavit.
    After making the affidavit, you have to publish the change of name etc, in two newspapers. One in a national newspaper in English and the other in a local language local newspaper. Once you do that, you have to get a copy of these newspaper advertisements and then you have to apply for a gazette publication. The lawyer who helped you in getting the affidavit made may be able to help you in this aspect also,
    There will be an application form. That is to be completed in presence of two witnesses and you have to take the signatures of the witnesses. You have to attach a copy of your affidavit, and copies of the paper advertisements. You have to send them in such a way that they will know the name of the paper and date of publication, The required fee is to be paid and a passport-size photo also is to be attached. This has to be sent to the government press where the gazette will be published.
    Your lawyer can guide you. Since it is the name of your father, he has to apply for the change.

  • Thankyou for your reply. I have one confusion. In my case there is no name change done by parents, they have simply made a one and the same person affidavit that both the names belong to the same person, so I am not sure whether I can get them to publish name change advertisement because they have not changed their names.

    Can my parents give a Public Notice in newspaper and subsequently in the Gazette in the same manner as you have suggested and then use it whenever any objection is raised?

    Satisfying reply received. The next question is, whether the State Gazette suffice or Central Gazette needed?

    It is all depend on your overall requirement (State law for certain deal and Central law for certain process). Since you have a Passport, it will be helpful if you could apply for a Central Gazette as well for this to avoid any future hurdle and consequences.
