  • How I can get NOC from Public sector bank where I am working?


    Are you facing issues with regard to getting NOC from the organisation where you are working now? Do you want to know the rule position in this connection and also as to how you can get the NOC? Follow this thread for detailed solutions.

    I am presently working as a clerk in a public sector bank in in a remote rural area where there is no connectivity and does not even have the basic facilities. The work pressure and risk is extreme. I have plans to prepare for a higher govt job but I not getting proper time due to the hectic work pressure.

    Now I have been selected in ESIC (Employees State Insurance Corporation) as MTS Multi Tasking Staff) and I want to join there because of urban posting and because I will also get sufficient time to prepare for other higher exams.

    But the bank is not giving me NOC and I have very less time to submit the same. They are saying that they can't give me the NOC now since I have joined recently only.

    What should I do now? What is the rule position in this connection?

  • First ensure that you are selected and will be getting the appointment order from the new employer. Ascertain the terms and conditions for joining especially the last date of joining.

    Then,
    Please refer your appointment order from the current employment(bank) and see the terms and conditions there. There may be a clause saying about notice period for resignation. If there is sufficient time gap for completing this notice period and the last date for joining in the new job, submit resignation of the current bank job.

    If there is no sufficient period available then,

    Find if there is any amount to be remitted in lieu of notice period to resign from current bank job.. If so you can submit resignation letter and remit the amount needed in lieu of notice period.

    If you don't have sufficient time period for completing notice period, and there is no alternative of emitting money in lieu of that, then I suggest you to try the following:

    1. Confide orally with your present superiors about your problem and the better prospects and convenience of the proposed new job.
    2. Seek their help to get you relieved as early as possible as a special case considering the genuine situation.
    3. Seek their advice in solving the issue without causing trouble to anyone.

    They may agree t help, orally. It depends on the mutual relationship and goodwill. But no one will be prepared to accept or give in writing.

    4. If the response is not favourable, then in the meantime take one or two day's leave and visit the recruiting office/regional office of the new proposed employer. Meet the relevant person there and tell your problems orally and seek their suggestion and help. Ask for extension of period to join if possible, so that you can complete the notice period in the current job.

    If none of the above works in your favour, and if you have not mentioned about your present bank job to the proposed employer, then take courage, submit resignation, request for early relief on a particular date and authorize them to recover any dues in lieu of that and after working till possible, join the new job. This has its own risk. But if you are still under probation, if you have the goodwill of your bosses and colleagues, there may not be much problems Resign quoting urgent personal reasons.

  • I think your probationary period has not been completed with the bank job. In that case, they will not issue any NOC. As per your terms of appointment, you can
    Surve your resignation letter along with the:
    amount of bond money if any
    and
    Salary of the notice period to your existing employer(bank)

    The amount will be available with the Accountant of your branch or with your regional bank.

  • Any organisation like banks will give you an appointment letter. Along with this appointment letter you will be given a copy of the rules and regulations of the bank also will be given. Your job will be covered by all these terms and conditions.
    As per your submission, you have already applied for a new job and got selected. Actually, the question of NOC comes when you are applying. Now the bank may not give a NOC to the staff who are on Probation period.
    You have to resign from the present job as per the terms mentioned. There may be a notice period clause in your appointment letter. You have to submit the resignation letter and then they will relieve you after completing the notice period.
    If you have no time, then you have to pay money in lieu of the notice period and then they may relieve you and give you the relieving letter. Using that relieving letter you can join in the new job.
    It is better to talk to your boss in the bank and be in touch with the administration department of the bank. They will suggest you the best course of action. Please remember that your appointment order is the final document which says about all the rules and regulations and the organisation will go by that only.

  • You have to go through the terms and conditions of your appointment in the bank where you are presently working. You will find that there will be a clause on the notice period and you have to resign from your job and give a notice for the stipulated time say 3 months or so to the bank. If you are not able to do that then you will have to deposit the salary for the equivalent of notice period. Just check in your administration wing about this aspect.
    What you have to do now is resign immediately and deposit the notice period equivalent amount and then only they will relieve you. If bank has incurred some expenditure on your training and they have taken a bond from you then in that case you might have to deposit that amount also. Check these points with your employer.
    It seems that you have not applied through proper channel. Have you mentioned in your application while applying in ESIC that you are working in the bank. If yes then they will ask for NOC. Actually NOC is nothing but a certificate to your character in the earlier organisation and gives confidence to your next employer to let you join there. It is only a formality but affirms ones credentials.
    You can also meet your area manager and request him to help you in this time of crisis. If he says that you have to deposit the notice period equivalent money then deposit it.

  • By going through your resume it is evident that you are under the probation period in your banking services and as such they are reluctant to offer you NOC as demanded by you for your smooth transition of your job from the present one to ESIC. In this situation, you might take the following steps to expedite the early relieving process for the next job. The following points might be helpful in your case.
    1) Go through the appointment letter received from the employer of ESIC and understand the rules and regulations indicated their in and ensure the compliance of these rules.
    2) Since your existing employer is not offering you NOC since you are a newly recruited employee and are still under the probation period. In that case, you have to intimate the personal department of the current company for your early release through the process of resignation.
    3) In that situation, you have to make payments for your earlier release since the notice period applicable in most of cases for the duration of three months is not being followed, otherwise serve the organisation for three months before getting relieved. You have to pay the remaining amount of the bond if applicable in your case.
    4) The present organisation might charge you that there is the case of violation of company rules since you did not apply for ESIS through the clearance of NOC of the existing organisation. This might be a bad conduct on your part.
    5) If needed meet the higher boss of the current company and patch up the controversy.
    6) The present organisation will relieve you subject to conditions that entire dues whatsoever is paid.
    7) Intimate your probable date of joining in the next organisation which suits you since relieving process takes sometime and this allowance is to be taken into consideration.
