    SC to pronounce judgement whether Aadhaar be insisted for every transactions ?

    Based on several complaints as to our personal details are being revealed to every authorities who insists for Aadhaar linkage to every transaction and thereby loosing the privacy of data of every Individual, the supreme court is slated to pronounce its judgement today. What is your view on this. Do you want to reveal your Aadhaar number for every transactions to which it is insisted or there should be fresh guidelines advised by the highest court to the government on only limited services to which Aadhaar be mandated.

    This is going to be a very interesting thing to watch. One side it is the concept of a card which is going to be linked to all our personal and financial details while on the other hand people are against it telling that it is attack on our privacy.

    Actually the idea of Aadhar card was something in the line of National Identity Card which is solution for all our credentials right from ration card to driving license. But unfortunately it did not happen and now we are stuck in between somewhere.

    In light of the above the hearing and judgement of SC is critical and will have long time consequences.

    Now we have the decision from the Supreme Court wherein the linking of Aadhaar with PAN or Permanent Account Number has been allowed for filing of income tax return (ITR) as a mandatory aspect of the process but on the other hand has ruled out as compulsory for the services such as bank accounts, mobile connections or school admissions. In addition, this has been suggested that the benefits under the Aadhaar project should be in the nature of welfare schemes only.

    Although this much-awaited verdict on the Aadhaar Card comes after several petitions which had challenged the system on the context that this may lead to violation of privacy of the individuals but possibly may lose the importance instantly as for crucial transactions & platforms this doesn't mandatory anymore.

    Every things have pros and cons. Aadhaar card is also not free from it. India is facing problem of illegal migration. In this situation we must have our ID card. Privacy can be maintained.

    The judgment has been pronounced. It is a 4-1 verdict. Hon'ble Supreme Court has upheld the Aadhaar project and the Aadhaar Act as Constitutional, with Hon'ble Justice DY Chandrachud dissenting. In a disappointing verdict for those intellectuals who have been fighting against Aadhaar, the majority judgments have held that the Aadhaar project does not create a surveillance state, and meets the three-part test as laid down in Hon'ble Justice KS Puttaswamy's judgment on the invasion of privacy.

    However, the ruling provided limited relief as several provisions of the Aadhaar Act, regulations and other notifications were either struck down or read down, and these changes are bound to have implications. The most important change is the partial striking down of Section 57. However, the overall implications will be properly understood after a detailed study of the judgment.
