    UCC Bill of Uttarakhand

    On 6th February 2024, the Pushkar Singh Dhami-led Government of Uttarakhand has passed the Uniform Civil Code (UCC) Bill in the Legislative Assembly of the state. Presently, the Bill is with the Governor of the state awaiting his assent.

    The salient features of the UCC Bill are as follows:-

    1. Provisions for equal property rights for sons and daughters
    2. Elimination of the distinction between legitimate and illegitimate children, inclusivity of adopted and biologically born children, and equal property rights after death.
    3. Mandatory registration of live-in relationships. Children born of live-in relationships will be considered legitimate, and deserted women will be entitled to maintenance from their partners.
    4. Complete ban on polygamy and child marriage
    5. A common marriageable age for girls across all faiths
    6. Similar grounds and procedures for divorce.

    The controversial provision in the Bill is regarding the live-in relationship. Many restrictions have been imposed in this regard. These are:-

    (a) Partners in live-in relationships have to submit a declaration to the district registrar
    (b) A copy of the declaration will be sent to the parents of the live-in partners if one of them is less than 21 years of age
    (c) Children of a couple in a live-in relationship will be considered legitimate
    Partners may terminate their live-in relationship by submitting statements to the Registrar
    (d) Women deserted in a live-in relationship are entitled to claim maintenance and may approach court
    (e) If partners are in a relationship for more than one month without submitting a statement, the couple may face jail term for three months or a Rs 10000/- fine, or both.
    (f) If live-in partners don't submit a statement after getting a notice, they may face jail term up to six months or be fined Rs 25000/-, or both.
    (g) Finally, these provisions will be equally applicable to the Uttarakhand residents in live-in relationships even outside the state.

    These restrictions/conditions on the live-in relationships have been severely criticized by many liberal-minded intellectuals of the country. However, in my opinion, these provisions will definitely eliminate various controversies regarding maintenance of live-in partners and inheritance of properties by children born out of such relationship.

    India is a big country and there are so many communities living here under the democratic set up and framework.
    It is necessary that we should have a uniform civil code for all the citizens of India and they should abide by it and help in the progress and development of the nation.
    In absence of a transparent civil code people start to have religious and other tendencies for their life styles and think that they can have a code of their choice. So this step of UCC is very good and is for the progress and prosperity of all the residents living in this country.
    Any rules introduced by Government for the overall progress of the nation as well as progress of the individual members of the society should be welcome by all then only India can progress and become the top country in the world.

    The author has presented the details which has been passed by the Government of Uttarakhand pertaining to the people following the live -in - relationship in the state.
    This issue was not being taken up so seriously in the past causing ambiguity in taking up any step but now it has been resolved and passed by the assembly of the state. This will ensure the compliance of the newly formed rule by all the responsible citizens.
    Up till now, there was no clear cut rule and as such the interpretation varied from citizen to citizen but now a rule has emerged and the public of the state needs to follow the same religiously.
    Hope the other states will also follow the rule enacted by the Uttarakhand Government so as to achieve a uniform set of the rule throughout the country.

    There was a talk about UCC long back and it was considered to be enacted in law and then was to be implemented. Unfortunately, the issue became much late and now some states have started to think in that direction and finally Central Government will also come up with some strong implementation of this necessary law.
    If it were implemented during 1947-1952 then by now everything would had been under established practice but due to the delay now many people who do not lead their lives as required in UCC will feel offended and oppose it. Old habits die hard and many people will not like to change themselves until they are forced under the law to change their ways.
    Many boys cheat girls by living with them in live-in relationship and then desert them. The girl cannot do anything as Govt rules are not there to protect her. So not only from the live-in relationship angle but from many other reasons UCC is required to discipline the citizens to behave in a correct fashion failing which they would be penalised or even jailed.
    I am sure that all the good citizens of this country will welcome this great law which is not only good for the citizens but also for the development of the country.

    It is relevant to recall Article 44 of the Constitution of India. Part IV, Article 44 of the Constitution states: "The State shall endeavour to secure the citizen a Uniform Civil Code throughout the territory of India".

    Uttarakhand has shown the way. Hope other Indian states will follow.

    It is a very welcome step from the Uttarakhand Governemnt. When we are in society all the society members should have the same rights and responsibilities. There should not be any discrimination based on their religion or caste. This UCC is a step in this direction. I welcome this UCC bill and hope all other states will also follow this state and try to implement UCC in their states.
    Equal rights to sons and daughters are already implemented in some states I understand. Living in relation is not considered acceptable to many Indians. But these days we are importing such practices from other countries. I feel the steps taken by this state government are very good to discourage such practices. If we encourage such practices the marriage system will collapse which is not desirable. I appreciate the state government for bringing out such a bill.
