    Whether it is time that reservations needed a revisit

    Reservations are the primary Affirmative actions intended to give representation to socially and Educationally Backward classes of society. No doubt one of the powerful tool to give equity in a society as diverse as ours. However, ever since Indira Sawhney case the concept of reservation has changed a lot from the concept of creamy layer, 50 percent rule, consequential seniority, catch up rule and so on. Presently the problems like same caste getting benefited repeatedly and few other not even included in education. Creamy layer and ews criteria are being easily violated by showing in paper as poor but actually being rich. Do the concept of ews , creamy layer need revision? Could Internal Reservations be a way forward?

    It is high time to review the reservation policy in our country. We are already late in doing that. There may be political compulsions but until we remove the reservations of all sorts except for the poor financial condition people, we cannot get rid of the big menace called reservation.
    Any reservation done on cast, creed, or religion basis is an unhealthy thing in the present context and a bold and strong Govt is required to abolish the old system and bring some fresh air in its place.
    If we do not abolish the existing reservation system then we will have aberration in our political set up and unnecessary conflict of interest will arise affecting the democratic setup.

    Thoughts exchanged is knowledge gained.

    It is the right time to relook into the reservation policy of our governments. This facility is provided in our Indian constitution to bring up downtrodden castes and tribes. This was intended for a few years only. But unfortunately, our politicians to keep their vote banks intact, the same is being extended from time to time. It is a real worry.
    We obtained freedom in the year 1947. From then onwards these reservations are in force. But the really disturbing aspect is deserving candidates do not benefit from these reservations. In the same family 2nd generation and 3rd generation, people also benefit from this policy, Some families don't even know these benefits,
    I think there should not be any reservations. If necessary financially backward people can be considered for some assistance for their children's education etc.
    In India only it is possible that a student who obtained 40% can get admitted into the college. But a student who obtained 80% will be waiting at the entrance of the college for a seat.

    Actually from seeing constitutionally, reservation is one area where Supreme Court of India and Parliament has been in disagreement in the implementation side. Right from Champakam Durairajan Case 1951, Supreme Court has always been worried about the Article 14, while Parliament has been worried about representation and Backwardness. Over the period Balaji Vishwanath and Indira Sawhney Cases have laid some broad principles. While Caste can be dominant factor in considering reservations it can never be the sole criteria. Social Backwardness must be objectively evaluated based on a Commission report and not merely based on polical considerations of Executive. The commission must set itself practicable and intelligible criteria for evaluation of Backwardness. Reservation must be proportionte to the Caste representation in population as well as backwardness. But the reality is different. In SC/ST reservation there are few castes which have benefited out of the reservation and have people are getting appointed in important positions in Government. While some castes are still living in villages with not even having access to Education and some ST people still living in forests secluded from society. In OBC the creamy layer criteria needs a revision. Because the same person is re using the benefit repeatedly to get into higher posts. For example, a person who has cleared IRS re writes with OBC quota to become IAS. Th result is that it goes against the principle of equality. while another person in OBC who poor is has to fight with the IRS officer to get into ranking. In ews , the asset criteria are very leaky. People just do benami transactions to hide their assets and become eligible for reservation under ews. So, in implementation lot needs to be done. It is time for Mandal 2.0. Mandal Commission has outlived its validity. Rohini Commission report must be taken into consideration.

    There was a time when reservation policy was welcome by most of the people in our country and it facilitated giving jobs to a large number of the backward society people to a great extent. But that objective is long met. Today there is no need for it. Unfortunately some political leaders want to keep this alive in order to get the votes from those communities. It is in a bad taste but in politics such things are very common.
    What is the solution to this problem? Only thing that comes to my mind is parliament should abolish the reservations of all kind except if any for the people below the poverty line. That would be a big decision and would be difficult to make because the opposition parties will definitely make a hue and cry on that. If the ruling party can take such bold decisions then the problem of reservation will get fully resolved.
    I hope such initiatives would be done by the new Govt during the next 5 years.

    Extending reservations year after year is not the solution. Moreover, this policy would make the people lethargic thinking that it would be futile to put more effort into their studies since they are sure to get jobs of their requirements. This theory does not hold good especially when vacancies are not generated adequately to take care of the youths waiting for unemployment.
    The job-seekers must have sufficient skills and qualifications to match the job profile. If that competitive feeling is missed, it is very likely that we will get a large number of youths not learning anything with interest. Hence it is time not to extend the reservation policy anymore,
    Let there be healthy competition among the youth to grab the right vacancy for them depending upon their ability and skills.
