    Pay Increment Date Rules

    I didn't applied to the new department through proper channel as I applied before joining my old department. But I declared the same at the time joining. So, I was applicable for Technical Resignation as per rules No.DOPT-1669266628362

    Hi sir, I am not able to find rule applicable for my specific case. As both levels are same & I am already having same basic pay I need clarity on date of increment but in those rules mostly about pay fixation and that too direct recruitment & I don't know whether mine in direct recruitment or not as I joined through gate exam and experience not required. And I have less than 1 year experience in old dep. In one rule it is mentioned that it requires min 6 months for increment in July 1 and I am having 8 considering old department.

    Hello friend.

    I am no longer regular on this platform. But as a Government official, I know this rule (technical resignation). You have joined a new Government office after tendering a technical resignation in your previous Government office. Please read your relieving order very carefully. Has it mentioned your increment date? Has the relieving order mentioned anything about the lien in your previous post? All these are important.

    I myself tendered technical resignation to join a post with higher pay-scale. As an officer dealing with Establishment (personnel) matters, I know very well that in case of technical resignation, your previous service period will be counted and the leave accumulated will be carried forward in the new office. But, you will not get any benefit regarding the date of increment.

    Your date of increment in the new office will be calculated on the basis of your joining date in the new office. The date of increment in the old office has no relevance.

    Please read 2.1 to 2.4 of the following DoP&T O.M.:

    "2.4 Pay Protection, eligibility of past service for reckoning of the minimum period for grant of Annual Increment

    In cases of appointment of a Government servant to another post in Government on acceptance of technical resignation, the protection of pay is given in terms of the Ministry of Finance OM No. 3379-E.III (B)/65 dated the 17th June, 1965 read with proviso to FR 22-B. Thus, if the pay fixed in the new post is less than his pay in the post he holds substantively, he will draw the presumptive pay of the pay he holds substantively as define in FR-9(24). Past service rendered by such a Government servant is taken into account for reckoning of the minimum period for grant of annual increment in the new post/ service/ cadre in Government under the provisions of FR 26 read with Rule 10 of CCS (RP) Rules, 2016. In case the Government servant rejoins his earlier posts, he will be entitled to increments for the period of his absence from that post."

    Please note: Pay protection is available if you join a post with less pay.
