A biased judge will deliver wrong judgement only

A judge should be neutral. He may be a judge in a court or he may be an umpire in a sports competition or he may be a judge in a competition to select the best performer. If he is not neutral and has a soft corner towards a party, there are chances he may give a judgement favourable to the party towards whom he has a soft corner.

A judge should be independent and impartial. He /she should avoid impropriety. He /she should be fully committed to delivering justice without any partiality. They should keep merit at the top of all other issues. If the problem of corruption gets into this system also the chances of society getting spoiled are high. Do you agree?

Impartial decision-making is a rare trait and not many humans have this quality. Nobody knows what's going inside a human brain and they usually have some partiality against someone even when seem to be a neutral.
    Thanks and regards.

The judge should be neutral in all the cases and this is the demand of the party who has approached a judge. However, he is influenced by the lawyer making arguments before the court. If the lawyer is strong enough, he can twist or change the entire scenario with a forceful speech. Such a speech is not a reflection of the true occurrence for which he has been produced before the court.
The most unfortunate part is that most of the victims are poor not having sufficient money to go to higher court in the event of a wrong judgement delivered by a court. The judge should look into the merit of the case and accordingly, he should deliver a judgement without being impartial.

Earlier t was "Yatha raja, thatha praja " and in the democratic era it is reverse- "Yatha praja thatha Raja".
We get rulers from among us and hence the rulers and the rulings would reflect society which elected or selected them.

The mores and values have undergone change and similarly the expectation and demands also have changed.
The judges also come from this society. Moreover if the judges are not given the due respect and compensation to insulate them from any possible temptation, then judgements tend to be flawed or even biased.

Judges are supposed to be unbiased and prudent in their approach. They have to go by the rules and regulations in the matter under the umbrella of existing constitutional framework. Parliament is empowered to change the laws of the land even if it requires changes in constitution.
Sometimes judges will give varying judgements due to difference in interpreting the law. We can't say that there is biasing in such cases.

    Thoughts exchanged is knowledge gained.

It's true that a person incharge of taking big decisions should be impartial because if such people become partial then they will destroy the whole integrity of the position. People will stop respecting the decision of the person if he/she takes a partial stand because of his/her affiliation to someone. We have seen in history that a great ruler was always prudent in his decision making process and always took decision which was correct. A great nation is built on the shoulders of such people who create an example for others to follow. If the person sitting at the top post becomes corrupt then the nation will surely be doomed.
Humble yourself or life will do it for you!

I have seen some organisations biting the ground due to the biased decisions of the decision-makers. They are awarding contracts to unsuitable fellows, bringing their people to key roles etc. These types of acts caused the decline of these organisations.

My view in this connection is the judges are not delivering wrong judgement with his bias mentality but with a feared mentality. Many decades back, an advocate was in Southern Tamil Nadu. He was about to have a promotion of Judge. One day a man with another's head in hand came to him for rescue as he was not culprit. The came person was a notary in that area and he threat the advocate to argue in the court for him favorably. Felt bad, the advocate he himself throw away his coat and dispensed himself from the profession even by removing his judge promotion. This was just to get away from compulsion.

A Judge should never have a fear of delivering justice. If he is having a fear, he should quit the position but should not give a biased judgment. Many times we hear about " Not before me". Some judges when they have close axis to one of the parties involved in the case will come out of that bench and ask the Chief Justice to appoint another judge. I think that should be the practice by all judges.
