There are two stages in the course:

The programme gives broad knowledge of intellectual property rights (IPRs) and their involvement in the R&D sector. All the different categories of IPRs such as Patents, Copyrights, Trademarks, Designs, Geographical Indications, TKDL, Plant Breeder's Rights (PBR), Plant Variety Rights (PVR), and Trade Secrets will be explained. Brief outlines of the important international treaties such as TRIPS, GATT, Madrid Protocol, PCT, etc., will be given. Apart from this, the discussion on other relevant topics like bioprospecting and bio-piracy will also be carried out. In this course, students will also learn about intellectual property rights in software technology development, Computer Related Inventions (CRI) and how they can be used in the software industry. IP laws that will be covered in this course are Indian Patents Law and patent filing procedure as per the Indian Patents Act, 1970 and Indian Patents (Amendment) Rules 2016; Indian Copyrights Law and filing procedure associated timelines as prescribed in Indian Copyright (Amendment) Act 2012 and Indian Copyright Rules (Amendment) 2016; Indian Trademarks and Unfair Competition Law and Trademarks filing procedure as prescribed in Indian Trade Marks (Amendment) Act, 2010 and Indian Trade Marks Rules, 2017; Indian Designs Law and Design filing procedures associated timelines as prescribed in Indian Design Act, 2000 and Indian Design (Amendment) Rules, 2014; Indian Geographical Indications Law and filing procedure of GI as explained in the Geographical Indications of Goods (Registration & Protection) Act, 1999 and the Geographical Indications of Goods (Registration & Protection) Rules, 2002. Participants will also learn about India's first Intellectual Property Rights (IPR) policy for awareness, creation, commercialization, protection, and enforcement of Intellectual Property (IP) and International Treaties. Lectures on the commercialization of IP and their applicability to achieve economic and social issues, the basic commercialization process including assignments and licencing and financial resources are the main part of this course. Under the management of IP portfolio, several important aspects that are helpful in effective implementation such as correct IP tools, procedural know-how, organisational traits and behaviours and strategic approach including the whole life cycle of a product, from conception to commercialization will be focused. These aspects will help to be equipped with the knowledge on how to IP protection while reducing risk and costs. An overview of competition law and its various aspects such as objects, advantages, implementations, and its evolution from the Nehruvian mixed model, the Prohibition of Anti-Competitive Agreements, Abuse of Positions of Dominance and Merger, Amalgamations and Acquisitions Control, and Remedies under the Competition Act will be taught in this programme. Lectures on the basics of IPRs, different types, principles, their importance and their role in many fields will be delivered. The relationship between IPR and competition law, and the role of TRIPS, is explained. The programme will also cover important issues such as maintaining the competitive structure of markets, the Competition Commission of India, and patent compulsory licencing. Standard-Essential Patents (SEP), Fair, Reasonable, and Non-discriminatory (FRAND) licencing in India, antitrust cases and litigation w.r.t. recent SEP and FRAND in India will be described in detail.
